Privacy Policy

Cybertrust Japan Co., Ltd. (“the Company” hereinafter) respects customer choice concerning the collection and use of personal information. The Company seeks to distribute information in a manner that focuses on the customer’s industry, the products they use, their role within their organization, and their choices. From time to time, the Company will ask customers to provide personal information so that it can provide customers with the information they need, meet specific customer needs, and to allow more effective use of the Company’s websites. The information collected and how this information is collected differ from site to site. This policy provides an explanation of how information is collected, the purposes for which it is collected, and what choices are available to customers.

The Company also provides links to external sites that it does not operate but feels would be of interest to customers. Links to these sites are provided for the sake of convenience, and these sites are not operated by the Company. We recommend that customers review the privacy policies established for these sites before providing personal information to site operators.

1. Types of data collection

The Company collects data from customers in four main ways:

  • Through registration screens and online forms
  • During the process of dealing with sales inquiries
  • From emails sent by customers to the Company

Through automatic means, such as communication protocols
The Company may also receive data from customers through their access to its websites (normal electronic dialog between the customer’s computer and network and the Company’s servers). This information generally comprises data on network routing (e.g., the customer’s location), device data (e.g., type of browser used), and access date and time.

2. Data collected and uses thereof

The Company collects information from customers for the following purposes:

For transactions and communication

Customer names, addresses, email addresses are collected and stored as part of the customer’s transaction history. Most of the information collected for this purpose is contact information for business purposes. The Company may share some of this information (addresses, payments) with delivery companies or other third parties whose involvement is required to complete the transaction.

To provide service and support in the future

Information collected for this purpose comprises contact information, information on products concerning what requests have been made, and information related to service/support. This information is also used to provide services and product updates and similar notifications.

From the results of product downloads

Users who download products under evaluation licenses and purchasers of products are sometimes contacted to confirm that no problem occurred during the download process. In addition, they may receive an alert when the license term (trial period) elapses. This information is not subject to the normal unsubscribe option for marketing information.

To respond to questions and requests from customers

This information includes information registered when subscribing to newsletters and individual requests for detailed information.

To provide partners and various other communities of the Company with warnings and the latest information concerning related products

Here, “latest information” refers to product announcements, pricing, terms, special terms, and related campaigns. This information is sent to partners with related programs or registered online accounts. It is not covered by the normal unsubscribe option.

To conduct marketing that meets the needs of users

The Company will sometime uses information on purchases by and requests from customers to provide customers with timely and appropriate information concerning product announcements and service development. This marketing information is covered by the normal unsubscribe option.

To improve responses to requests for services and price estimates for products and devices

To follow up on customer requests, the Company will sometimes provide customer contact information to the appropriate sales person of the Company, agent, distributor, or consultant. The Company may ask a customer if they would like their contact information to be shared with specific partners who provide complementary products or services that relate to their inquiry. If the customer’s consent is obtained, their information is provided to the partner to allow response to offers to provide services or information. If you need further information from a partner concerning the provision of information, please refer to that partner’s privacy policy.

To provide information about training events or related partner products

From time to time, the Company may organize joint events with partners who provide services that the Company’s customers may find useful. The Company may provide information on training events and services to customers who have expressed interest in such events and services. The Company will give due consideration to the protection of customer information, retain total control over customer information, and place restrictions on use of customer information by its partners.

To strengthen joint sales or sales promotion

From time to time, the Company and its partners will hold joint events and provide bundled products. In the event of such promotions, the name of the partner will always be displayed. Both the Company and the partner have access to each other’s customer information. While the Company chooses its partners carefully, since privacy is a highly subjective issue, we recommend that customers read the privacy policy of the partner concerned. Examples of such partnerships include joint seminars, joint sales promotions, jointly developed products, and joint announcements.

From the results of registration for participating in applying to participate in the Company’s conferences or events

Existing customers or users who have registered at www.miraclelinux.com who apply to participate in conferences or events may be contacted prior to the event to confirm whether they need information on meetings or other information. This information is used only by the Company or a limited set of partners of the Company and is not disclosed to third parties. The Company will duly consider the protection of customer information, centrally manage customer information, and require partners to use customer information only for purposes clearly related to the customer’s profile. For detailed information, please refer to the supplementary information attached to the privacy policy displayed on each conference site.

From the results of participation in interactive discussions and public forums

Some websites allow users to participate in interactive discussions. Some of the websites are managed by an administrator. All websites may be accessed for technical reasons. The Company does not control the content posted by users, and a number of these ties are used as general discussion forums. Please be careful when posting personal information on interactive forums, as it can be viewed by many other users.

To improve performance and resolve issues

From time to time, the Company provides software updates such as patches for updating software (e.g., security patches addressing newly discovered vulnerabilities). The Company may provide information on patches or software updates to the registered licensed user of the software and persons who have declared to the Company that they are a user or a developer. This information will not include sales messages; due to the importance of patches or software updates, this information is not subject to the normal unsubscribe option. The Company may be asked to submit personal information to comply with legal procedures such as legally-mandated reports as a result of legal demands and disclosing information.

Collection, use, and handling of personal information from the Cybertrust online shop

The Company will use information concerning registered individuals, organizations, and corporations to sell state-of-the-art functions and services and will take the utmost care in safeguarding member personal information.

The Company’s personal information policy applies only to services it provides directly. Services provided by other organizations, companies, etc. that can be accessed through links etc. on the Company’s website lie beyond the scope of application of this policy.

Users are responsible for their use of the Company’s services.

The Company accepts no liability for any damages incurred through the use of the various types of information obtained by these sites or other sites accessed through links posted on them.

The Company requires several types of personal information to provide customers and companies with state-of-the-art functions and services.

  • The Company asks that users assume personal responsibility for managing IDs and passwords.
    • We recommend that users change their passwords periodically and to avoid using passwords that may be easily guessed. For example, avoid using names, dates of birth, telephone numbers, etc. as passwords.
    • Never disclose, lend, or transfer your password to anyone else, even if they are friends, acquaintances, etc.
    • Do not include your password in email inquiries or in Q&As on the Company’s websites.
  • The personal information collected is used only to the minimum extent necessary to provide the Company’s services.

3. Registration of customer profiles, settings, and unsubscribe options

As part of the initial setup required to provide access to its websites, the Company allows site visitors choose whether to participate in communities by completing procedures for registering their customer profile. The Company eventually plans to include in the registration procedures a mechanism for enabling the customer to control settings and information distribution.

Communication options

The Company understands that users may not want to receive information about new products or related products. At www.miraclelinux.com, users can choose to unsubscribe from email marketing based on their use of the site.

This option can be selected at the registration phase or by using the link displayed in the emails.
Customers can return to their registered profiles at any time to change their subscriptions. Note that certain services do not allow users to unsubscribe from their registered profiles. If you cannot unsubscribe from your registered profile or you encounter other issues, please send an email to Customer Information Administration at Cybertrust Japan Co., Ltd. (ctadmin@miraclelinux.com). Please put “Inquiry Concerning Profile Registration/Update” in the subject of the email. Explain what you want done or the nature of the problem in the body of the email.

There are certain unsubscribe exceptions (cases in which it is impossible to unsubscribe). In these cases, the Company will explain that providing certain information is part of the service provided. Unsubscribe exceptions include the following: notifications concerning patches and product security updates; notifications provided when products are downloaded; specific notifications provided on the basis of specific transactions or user communities (e.g., price/product-related notifications to members of the Company’s sales agents etc.); and certain notifications concerning conference attendance and registration.

Other companies’ subscriber lists

The Company sometimes uses third-party subscriber lists. These are third-party-managed lists that comprise users who have given their consent to receive emails from other companies (e.g., from the Company). Third parties with a direct relationship to the customers manage lists and requests to unsubscribe, remove users, or remove registrations to receive emails. The Company cannot access names on these lists. As the sender of the emails, the Company will clearly indicate the administrator of any list it uses and ask the list administrator to provide an appropriate mechanism to allow unsubscribing. The Company recommends that users use the unsubscribe function provided in each email. Information sharing options

The Company shares information with only selected companies after providing users with a means of unsubscribing or subscribing from information sharing. However, the choice of unsubscribing or subscribing may be restricted. Examples include cases in which information from a joint sales promotion or a joint event is supplied to the Company and another company at the same time; cases in which a partner of the Company is asked to provide follow-up support; cases in which information needs to be shared with third parties to complete delivery or execute a transaction; and cases in which information must be shared due to the nature of the service. Other than those above, there would be cases in which a third party or partner of the Company is providing the service.

4. Procedures for updating customer profiles

The Company produces and maintains accounts or information profiles for customers. The Company also manages this information and takes steps to ensure that customers can update this information at any time.

To update your profile, log in as usual and follow the instructions for changing your profile or updating registered information. Although the Company is moving to expand the scope of information customers can access and update themselves, with certain services, it is impossible to unsubscribe from the registered profile. If you are unable to unsubscribe in the manner described above, if you need further help in relation to your information, or if you have had problems accessing your profile, please send an email to Customer Information Administration at Cybertrust Japan Co., Ltd. (ctadmin@miraclelinux.com). Please put “Inquiry Concerning Profile Registration/Update” in the subject of the email. In the body of the email, explain that you want your profile to be updated or describe the problem you encountered when you tried to update your profile.

We try to respond swiftly to nearly every question or issue related to access, but those involving several complex requests may require further investigation and take additional time. If an issue related to access cannot be resolved within 30 days, we will inform you of the nature of the problem and the steps that need to be taken next.

5. Security

The Company takes the utmost care to ensure the confidentiality of personal information it has obtained and employs reasonable measures to prevent unauthorized access to this information. These measures include a policy, procedures, and technical matters related to the control of data access

6. Cookies

When a customer visits one of the Company’s websites, cookies are used to make browsing the website more convenient.

Cookies comprise information related to the operation of the website and are sent by the server to the customer’s browser and stored on their computer. This information includes nothing that could be used to identify an individual, such as the customer’s name, address, or telephone number.
Cookies also have no adverse effects on the customer’s computer.

A customer can set their browser to refuse to receive cookies. This will not affect their ability to view the website, although it may render some functions unavailable. Please consult the developer of your browser for information on how to block cookies.

7. Remarketing of the Company’s websites through online advertising

To reach as many people as possible concerning its services, the Company sometimes uses remarketing functions for online advertising.

Advertisements for the Company’s sites are displayed on various Internet sites by third-party distributors such as Google.

Third-party distributors such as Google use cookies to display advertisements based on data on past access to the Company’s websites.

Customers can disable use of cookies by Google by accessing Google’s opt-out page for advertisements. (Customers can also disable use of cookies by third-party distributors by accessing the opt-out page of the Network Advertising Initiative.)

8. Update of this policy

Customers will be informed by email if their personal information will be used in a manner different from that stated at the time it was collected. Customers can then decide whether to allow the Company to continue to use their personal information. If the Company has implemented a material change in its handling of privacy but that change will not affect existing user information stored in its database, a prominent notice will appear on this website to inform users of the change. Even if the Company has displayed such a notice, users who have requested to be sent notices by the Company may be sent notices of changes in the handling of privacy by email.
